Health Insurance and Personal Injury Settlements
If you were involved in a car accident and you have Health Insurance, you should be using your health insurance to pay your bills. Even if the accident is the fault of the other driver, you should still use the benefits provided to you by your health insurance for any and all treatment you receive. However, you must remember that should you reach a settlement on your case, you may have to reimburse your Health Insurance out of any settlement proceeds.
This is where it is important to know the law on this matter. Failure to reimburse your health insurance could result in significant issues later down the road that may impact your coverage. In Virginia, there is an anti-subrogation statute, Virginia Code §38.2-3405 states “No insurance contract providing hospital, medical, surgical and similar or related benefits, and no subscription contract or health services plan delivered or issued for delivery or providing for payment of benefits to or on behalf of persons residing in or employed in this Commonwealth shall contain any provision providing for subrogation of any person's right to recovery for personal injuries from a third person.” There are exceptions to this law that provide for repayment to your health insurance from a personal injury settlement. It is important to have counsel on this matter to help guide you in determining whether or not your Health Insurance must be paid back or not.
It is also important to know the coverages you may have available to you. While most health insurance plans require co-pays or deductibles, if you have the proper coverage on your vehicle, you may be eligible for direct reimbursement for those out of pocket expenses. That reimbursement would come prior to resolution of your personal injury claim and help ease the burden of covering medical bills.
